Terms of sale of Capolino 1929.

These general terms and conditions of sale govern the purchase of products and services made remotely through the telematic network on the website www.capolino1929.com, located in Rome (RM), via Ardeatina, 775. Purchases are reserved for direct customers and resellers. Each purchase transaction will be regulated by the provisions of Legislative Decree no. 185/99 (implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts) and, as regards the protection of personal data, will be subject to the legislation of Legislative Decree 30 June 2003 no. 196 (Unified Privacy Code).
Capolino 1929 may be obliged to modify some of these provisions; therefore, customers are advised to read the Terms of Sale each time they visit the Capolino 1929 website. The validation of the order will be considered as acceptance of the Terms of Sale, with no possible recourse.
By purchasing from the "Capolino 1929" website, customers undertake to comply with the Terms of Sale.

The photographs depicting the products are not part of the contractual scope and cannot under any circumstances be considered the responsibility of Capolino 1929.
The technical specifications and descriptions of the products are provided by partners and/or suppliers of Capolino 1929, which disclaims any responsibility regarding their content.

Prices and Purchasing Methods

Capolino 1929 is a website for the sale of heating and plumbing products, bathroom furniture, faucets, flooring, parquet, and much more. Customers can purchase the products described online in the respective technical data sheets at the price indicated on the website. The sales prices are expressed in euros (€) and inclusive of VAT.
At the time of order completion, the shipping costs will also be specified.
Before confirming the purchase, a summary will be displayed to the customer, containing the unit cost of each selected product, the total cost in the case of purchasing multiple products, and the corresponding shipping costs.

Availability

Customer orders are fulfilled within the limits of the quantity of available products. In the event that the chosen product is not available, the customer can request a quote, and Capolino 1929 undertakes to respond via email within 3 working days from the date of the request with information regarding the estimated delivery time of the product. If only some of the selected products are not available, Capolino 1929 undertakes to immediately ship the available products and cover the delivery expenses related to the shipment of the remaining products. If the unavailability of the product is due to a definitive discontinuation of its production by the manufacturer, Capolino 1929 will propose to the customer a product of equivalent quality and price. In case of customer refusal, Capolino 1929 will proceed with the refund of the unavailable product.

Delivery and Shipping Methods

The order will be delivered to the address indicated at the time of the order. The shipping rates also include packaging costs. Capolino 1929 offers various delivery methods:

  • We use express courier for shipping, and prices depend on weight and volume.
  • The goods can be picked up at the store.
  • The delivery time indicated on the Capolino 1929 website is indicative and subject to change. We also remind customers that couriers only transport and deliver products on business days. Capolino 1929 cannot be held responsible for any consequences due to possible delivery delays or loss or damage of the order by the courier. In the event that the order has not been delivered within the expected timeframe, Capolino 1929, upon customer request, can investigate the reasons for the delay. During this period (approximately 15 days), it will not be possible to proceed with a refund or a new shipment of the order.

Delivery will be made by the national courier, and to obtain delivery status information, customers should provide the courier with the waybill number received via email.

Important Instructions for Receiving Products. Upon delivery of the goods by the courier, it is recommended to check that:

  • The number of packages delivered corresponds to what is indicated in the transport document.
  • The packaging is intact, undamaged, not wet, or otherwise altered, including the closing materials (adhesive tape or metal straps).
  • Any damages or discrepancies in the number of packages or indications must be immediately reported to the courier making the delivery by accepting the goods with a cautious reservation to be written exclusively on the courier's delivery document (not on a copy of the invoice!). For example, "Accepted with reservation to check box with holes on the right side", "open box"... accept with reservation to check disconnected package, accept with reservation to check dented packaging, courier tape, etc. If the product is visibly damaged or the courier refuses to accept the reservation on the delivery document, refuse the product and indicate on the document "package refused because it is visibly damaged" or "package refused because the courier refuses the reservation" and immediately inform us.

Attention:
We remind you that in order to obtain compensation for any damages, it is important to accept the shipment by adding the following statement to the courier's delivery document (not on a copy of the accompanying invoice): e.g., "I accept the goods with the reservation to check because the package is damaged, etc."

It is mandatory to add the control reservation statement even if the package appears externally intact (e.g., "I accept the goods with the reservation to check, package intact"). Once the courier's document is signed, the customer cannot raise any objections regarding the external characteristics and physical integrity of the delivered items. Therefore, if products are accepted without reservations, no claims will be accepted, and it will not be possible to initiate procedures for replacing the goods. Any problems concerning the received products must be reported within 8 days from the date of delivery (the date indicated in the courier's delivery document will be considered valid).

Insurance

Customers have the possibility, at the time of order delivery, to check that the package does not show any external damages or anomalies. For each delivery, customers must sign with a reservation. In case the product or the packaging shows evident damages, we recommend filling out the provided form and not accepting the delivery, returning everything to the courier who will arrange for the re-dispatch of the product. Customers must also send an email to the following address: support@capolino1929.com.

Additional information may be requested from customers to definitively validate the purchase. To allow Capolino 1929 to contact them if necessary, customers are kindly asked to provide:

  • A functioning email address.
  • A phone number.
  • Right of withdrawal - satisfaction guaranteed or refunded

The sales of products via the Internet are regulated by the Legislative Decree No. 185 of 22/05/1999, which governs distance contracts, i.e., contracts concluded outside of commercial premises.

This legislation establishes the right of withdrawal, i.e., the possibility for the consumer to return the purchased product and obtain a refund of the incurred expenses.

This right is exclusively reserved for individuals (consumers) and cannot be exercised by legal entities or individuals acting for purposes related to their professional activities.

To exercise the right of withdrawal, it is necessary to send the items for which the right is intended to the address of Outlet Ceramiche Srl, Via Ardeatina 775-00178 Rome (RM), within 10 working days from the receipt of the goods.

The shipping costs for returning the product are entirely borne by the customer.

The right of withdrawal is void if the returned product is not intact, including:

  • Lack of the original packaging.
  • Absence of integral elements of the product (accessories, instruction manuals, etc.).
  • Product damage.

Capolino 1929 will initiate the refund process within 30 working days following the shipment of the goods by the customer and upon receipt of the goods. Capolino 1929 will reject any unboxed product returned, as well as products for which the customer has not fully paid the return costs. The refund will be made by bank transfer.

Warranties and after-sales service

The products sold on Capolino 1929's website are covered by the manufacturer's legal warranty of conformity, without prejudice to other legal provisions, starting from the date of product delivery.

The costs for reshipping the faulty or defective product are borne by the customers. Regardless of the problem with the product, it must be sent back accompanied by a copy of the invoice.

Attention: The legal warranty does not apply to damages caused by external factors (e.g., accidents, impacts, lightning, voltage fluctuations, etc.) or customer errors (such as the use of an installation not compliant with the manufacturer's specifications, a use of the product that is harmful to it, a use of the product for commercial or collective purposes, the use of unsuitable peripherals and/or accessories and/or consumables).
